1. INTRODUCTION

1.1. By using our website www.hayduswimwear.com or by entering into any agreement with Haydu Swimwear (“We”, “Company”), you agree to be bound by these Terms.

1.2. These Terms are to be read alongside our other terms and policies, including our Privacy Policy and Returns & Refund Policy. These are available on our website or on request.

2. INTERPRETATION

2.1. Definitions:

  • Agreement: Any agreement, express or implied, between the Company and the Customer.

  • Business Day: Any day other than a Saturday, Sunday, or public holiday in England, when banks in London are open.

  • Contract: The contract between the Company and the Customer for the sale of Goods.

  • Company: Haydu Swimwear, operated by Haydu Ltd, registered in England and Wales.

  • Customer: The person purchasing the Goods.

  • Goods: Swimwear or other products purchased from the Company.

  • Order: The Customer’s order placed via the Website.

2.2. References to statutes include amendments or re-enactments. “We” means the Company and “you” means the Customer.

3. BASIS OF CONTRACT

3.1. These Terms apply to the exclusion of any other terms that the Customer may try to impose.

3.2. Orders constitute an offer to purchase the Goods under these Terms. Orders are only accepted when the Company issues written confirmation.

3.3. Quotations do not constitute an offer.

3.4. Our Website is not directed at minors, and we will not contract with anyone under the legal age to enter binding agreements.

4. SUPPLY OF GOODS

4.1. The Goods are described on the Website.

4.2. All images are for illustrative purposes only. Minor variations in colour, style, or design may occur.

4.3. By placing an order, the Customer acknowledges that the Goods are made of 73% nylon and 27% spandex and agrees that they are aware of the material composition. The Customer cannot hold the Company liable for issues related to the material.

4.4. Changes to orders after dispatch are not possible, except as permitted under our Returns & Refund Policy.

5. DELIVERY

5.1. Delivery times are approximate. We are not liable for delays caused by events outside our control.

5.2. Delivery is completed upon arrival at the designated address.

5.3. Shipping costs are as indicated at checkout.

5.4. International Orders: Customers ordering from outside the UK are responsible for customs duties, taxes, and other fees. We are not liable for delays or additional costs resulting from international shipping.

6. COMMUNICATION

6.1. While we aim to respond to messages promptly, we cannot guarantee immediate replies. Customers acknowledge that delays may occur and the Company is not liable for missed emails or messages.

7. PRICE AND PAYMENT

7.1. Payment is via Shopify Payments (debit/credit cards) or PayPal. Klarna is not currently supported.

7.2. Prices are as indicated at checkout and include applicable UK VAT where applicable. Customers are responsible for any additional international taxes or fees.

8. LIMITATION OF LIABILITY

8.1. Nothing limits our liability for death, personal injury, fraud, or defective products under applicable law.

8.2. We are not liable for indirect or consequential losses, including loss of profit, business interruption, or reputational loss.

9. INTERNATIONAL ORDERS

9.1. Customers outside the UK agree to comply with local laws and regulations regarding import and use of Goods.

9.2. We are not responsible for delays, customs issues, or additional fees in other countries.

10. INTELLECTUAL PROPERTY

10.1. All content on the Website is the property of Haydu Swimwear unless otherwise stated.

10.2. Customers may use the content for personal use only. Commercial use is prohibited without written consent.

11. GOVERNING LAW

11.1. These Terms are governed by the laws of England and Wales.

11.2. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
